Terms of Service

1. Agreement to these Terms

By downloading, accessing, or using the Olua application or any related service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. You must be at least 13 years old to use the Service.

2. What Olua is — and what it is not

Olua is an informational and educational tool. It identifies ingredients in food products and connects them to (a) published, peer-reviewed research and (b) the regulatory status of those ingredients (for example, whether a regulator permits an ingredient and any stated acceptable daily intake, or whether it is restricted in certain jurisdictions). Olua organizes this information into descriptive tiers that reflect the weight and direction of the published research associated with a product's ingredients.

Olua does not, and is not intended to:

• determine, state, or imply whether any food, beverage, or ingredient is "safe" or "unsafe," "healthy" or "unhealthy," or whether you should or should not consume it;
• provide medical, nutritional, dietary, diagnostic, or treatment advice;
• create a doctor–patient, dietitian–client, or other professional relationship;
• substitute for the advice of a qualified healthcare professional.

The tiers and information presented are descriptions of available research and regulatory positions, not recommendations, endorsements, warnings, or safety determinations by Olua.

3. Not medical advice

The Service is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or another qualified health provider with any questions you may have regarding a medical condition, a dietary decision, allergies, or before making changes to your diet. Never disregard professional medical advice or delay seeking it because of something you read or saw in the Service. If you think you may have a medical emergency, call your doctor or emergency services immediately.

4. Accuracy, sources, and limitations of the information

• Third-party and user-generated data. Product, barcode, and ingredient information is drawn in part from third-party and community-maintained databases (including, for example, Open Food Facts) and from optical reading of product labels. This data may be incomplete, outdated, mislabeled, or incorrect. Manufacturers change formulations without notice.
• Scientific literature. Citations link to published studies (e.g., via PubMed). Scientific findings are often preliminary, mixed, contested, or later revised. The presence of a study does not establish causation or a conclusion about any individual's health, and Olua does not represent that any cited study is definitive.
• Regulatory information is provided for general reference, may change, and may differ by jurisdiction. It is not legal or regulatory advice.
• Coverage gaps. Some products are not in any database, and some ingredient lists cannot be fully matched. Olua indicates lower confidence in such cases, but you should not treat any result as complete.

You are responsible for verifying any information that matters to you, particularly regarding allergens and personal health conditions, by reading the actual product packaging and consulting professionals.

5. No warranties

THE SERVICE AND ALL INFORMATION IN IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT INFORMATION WILL BE ACCURATE OR COMPLETE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OLUA AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR DIETARY, PURCHASING, OR HEALTH DECISIONS, RELIANCE ON ANY INFORMATION IN THE SERVICE, OR ANY ERRORS OR OMISSIONS IN THE DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.

7. Your responsibilities and acceptable use

You agree not to: misuse the Service; rely on it for medical decisions; scrape, reverse-engineer, or overload it; resell or commercially exploit its output without permission; or use it in violation of any law. You are solely responsible for your decisions about what to buy or consume.

8. Intellectual property

The Service, including the Olua name, tier system, curated knowledge base, software, and design, is owned by Filanostic, LLC and protected by intellectual-property laws. Cited third-party study titles and data from sources such as Open Food Facts and PubMed remain the property of their respective owners and are used under their applicable licenses/terms. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use.

9. Third-party services and content

The Service relies on and links to third-party services and data (e.g., Open Food Facts, PubMed/NCBI, our AI provider, hosting, and analytics). We do not control and are not responsible for third-party content, availability, or practices. Your use of those services may be subject to their own terms.

10. Changes to the Service and Terms

We may modify or discontinue the Service, the knowledge base, or these Terms at any time. Material changes to the Terms will be posted with an updated "Last updated" date. Continued use after changes constitutes acceptance.

11. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms.

12. Governing law and disputes

These Terms are governed by the laws of the [State of formation — confirm for Filanostic, LLC], without regard to conflict-of-laws rules. The exclusive venue for any permitted court action is [County/State venue].

13. Severability; entire agreement

If any provision is found unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
